【摘要】:ISO22857:2004providesguidanceondataprotectionrequirementstofacilitatethetransferofpersonalhealthdataacrossnationalborders.Itdoesnotrequiretheharmonizationofexistingnationalstandards,legislationorregulations.Itisnormativeonlyinrespectofinternationalexchangeofpersonalhealthdata.However,itmaybeinformativewithrespecttotheprotectionofhealthinformationwithinnationalboundariesandprovideassistancetonationalbodiesinvolvedinthedevelopmentandimplementationofdataprotectionprinciples.Thestandardcoversboththedataprotectionprinciplesthatshouldapplytointernationaltransfersandthesecuritypolicywhichanorganizationshouldadopttoensurecompliancewiththoseprinciples.ThisInternationalStandardaimstofacilitateinternationalhealth-relatedapplicationsinvolvingthetransferofpersonalhealthdata.Itseekstoprovidethemeansbywhichdatasubjects,suchaspatients,maybeassuredthathealthdatarelatingtothemwillbeadequatelyprotectedwhensentto,andprocessedin,anothercountry.ThisInternationalStandarddoesnotprovidedefinitivelegaladvicebutcomprisesguidance.Whenapplyingtheguidancetoaparticularapplication,legaladviceappropriatetothatapplicationshouldbesought.Nationalprivacyanddataprotectionrequirementsvarysubstantiallyandcanchangerelativelyquickly.Whereasthestandardingeneralencompassesthemorestringentofinternationalandnationalrequirements,itneverthelesscomprisesaminimum.Somecountriesmayhavesomemorestringentandparticularrequirements,andthisshouldbechecked.
